Terms of Service

Effective Date: May 20, 2026

1. Agreement

By accessing our website or purchasing services from Lumorix Creative, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

Lumorix Creative provides AI-powered creative solutions including AI content creation, AI design systems, AI branding concepts, AI-generated visuals, automated creative workflows, and AI creative consulting. All services are delivered digitally unless otherwise specified in a project agreement.

3. Project Agreements

Each project is governed by a separate Statement of Work (SOW) or project brief agreed upon by both parties. The SOW defines scope, deliverables, timelines, and pricing. Changes to scope must be agreed upon in writing and may result in additional fees.

4. Payment Terms

Payment schedules are defined per project. Standard terms require a 50% deposit before work begins, with the remaining balance due upon delivery. Invoices unpaid after 14 days may incur a 1.5% monthly late fee. We reserve the right to pause work on overdue accounts.

5. Intellectual Property

Upon receipt of full payment, you receive full ownership rights to final deliverables. Lumorix Creative retains the right to display completed work in our portfolio unless you request confidentiality in writing. We retain ownership of all preliminary concepts, drafts, and AI model configurations not included in final deliverables.

6. AI-Generated Content

Our services leverage artificial intelligence tools. While we curate, direct, and refine all AI outputs, you acknowledge that AI-generated content may have limitations. We make no warranties that AI-generated content is free from third-party intellectual property claims. You are responsible for reviewing deliverables for compliance with applicable laws in your jurisdiction.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This obligation survives termination of the service agreement for a period of two (2) years.

8. Limitation of Liability

Lumorix Creative's total liability for any claim arising from our services shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate a project with 14 days written notice. You are responsible for payment of all work completed up to the termination date. Deposits are non-refundable upon termination initiated by the client.

10. Governing Law

These Terms are governed by the laws of the State of Montana, USA. Any disputes shall be resolved in the courts of Flathead County, Montana.

Refund Policy

Effective Date: May 20, 2026

1. General Policy

Due to the custom and digital nature of our AI-powered creative services, all sales are generally final. However, we are committed to client satisfaction and handle refund requests on a case-by-case basis with fairness and transparency.

2. Deposits

All project deposits (typically 50% of the total project fee) are non-refundable. Deposits cover initial discovery, AI system configuration, creative strategy, and resource allocation that begins immediately upon project kickoff.

3. Eligibility for Refund

A partial or full refund of the remaining balance (excluding the deposit) may be considered in the following circumstances: (a) Lumorix Creative fails to deliver agreed-upon deliverables within the timeline specified in the SOW without reasonable cause; (b) the final deliverables materially deviate from the agreed scope and revision rounds have been exhausted without resolution; (c) a project is cancelled by Lumorix Creative prior to completion.

4. Revision Policy

All projects include a defined number of revision rounds as specified in the SOW (typically 2–3 rounds). Refunds will not be issued for dissatisfaction with creative direction if the client approved the initial concept and revision rounds have been completed.

5. AI-Specific Considerations

AI-generated outputs are inherently variable. We do not offer refunds solely on the basis that AI-generated content does not match a subjective creative preference, provided the deliverables meet the agreed technical and creative brief. We will always work with you through revisions to reach a satisfactory result.

6. How to Request a Refund

To initiate a refund request, contact us in writing within 7 days of receiving your final deliverables. Include your project name, invoice number, and a detailed description of the issue. We will respond within 5 business days.

7. Processing

Approved refunds will be processed to the original payment method within 10 business days of approval. Processing times may vary depending on your financial institution.
